The Consumer Directed Services Program (CDS) is available for Missouri
Medicaid eligible persons with physical disabilities. The CDS Program empowers the consumer to hire a personal care attendant
to help them with their activities of daily living.
This program is Medicaid funded. There is no expense
for the consumer.
Eligibility
Eligibility requirements
for the CDS Program are as follows:

disabled ·
Mentally capable of making decisions regarding
both your healthcare and your employer responsibilities · Over 18 years
of age · Score at least 21 points
on a needs assessment performed by DHSS

Medicaid Consumer Directed Services, you can:

On My Own, Inc. ·
Receive
a comprehensive evaluation and assessment of your care needs through DHSS.

Program
Administration The Missouri Centers for Independent Living, in conjunction with the
Missouri Department of Health and Senior Services, administer the program. The philosophy of the Center
for Independent Living is consumer controlled, community based options that promote independence for persons with physical
disabilities.
Definition
Some persons
with disabilities require assistance with the activities of daily living to live independently within their communities.
Until 1999, persons with disabilities had limited options such as dependency
upon family members, placement in institutional settings, or paying for these types of services out-of-pocket.
Missouri Medicaid CDS services are funded with federal and state moneys.
This program allows the redirection of Medicaid dollars for in-home, consumer directed services, eliminating the necessity
of placement in residential facilities due to lack of options.
The Consumer Directed Services Program is a program that allows an individual to direct his
or her own personal assistance services at NO cost to the consumer.
Being on a consumer controlled personal attendance services program gives the person with a disability control
over their own life. To do this, the person with a disability becomes an employer and hires their personal
attendant. The attendant’s job description can include: housekeeping, laundry, cooking, personal
care, and transportation.

Compliance
with the Civil Rights Act
No person shall, on the grounds of race, color, national origin, age, disability,
religion or sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination.
If you feel you have been discriminated against on the above grounds,
you may make a complaint in writing to the Department of Social Services, or the United States Department of Health and Senior
Services.
Your Responsibilities
You and DHSS will develop a plan to assist you with your personal care needs. It is your responsibility
to put forth your best effort by participating in the development of this plan.
Upon approval for CDS, On My Own, Inc. will need copies of your Missouri Medicaid card and your
Social Security Card to set you up as an employer. You will need to forward any correspondence from the
IRS to On My Own, Inc. so we can pay all taxes that are due on your behalf.
It is important that you follow the guidelines of your plan.
Failure to do so can result in the denial or termination of your services.
Your attendant can be anyone who is age 18 or older and not a spouse. They must pass a
background screening. The attendant can be a relative, but not a spouse.
You will be shown how to train your attendant on how to complete
your authorized tasks and insure that time sheets are completed daily and accurately.
Your On My Own,
Inc. Independent Living Specialist (ILS) is required to make
at least monthly phone contact and visit you in your home every three months to insure your plan is meeting your needs and that
program rules and regulations are being followed.
Your ILS will train you on the complete list of both On
My Own, Inc.’s responsibilities and your responsibilities.
Fraud, abuse and neglect are taken very seriously; these issues
will be reported to the proper authorities.

Your Right to Appeal If you feel you were denied the service or provider of your choice, or your application was not processed promptly,
or you disagree with any agency decision concerning your case, you have the right to appeal this decision. If
you wish to request a hearing you may do so by contacting the Department of Health and Senior Services. Contact
On My Own, Inc. for details. If you request a hearing within ten (10) days of the date of the notice, you have the right to continue any benefits
and/or services already being received. If the agency’s decision is upheld, the state has the right
to recoup the cost of any services furnished as a result of your request for continuation of the benefits and/or services. On My Own, Inc. or DHSS can provide
further information on your rights.
